Common reasons

“Classy Hotel”, a small but busy hotel who were well known for their great swimming pool and casino, had a customer trip on the lawns and file a lawsuit against them for injury they suffered in their grounds. The customer was 80 years old with a physical disablement and was also under the influence of alcohol. There were clear signs to warn customers to walk carefully and only on the marked footpath. The customer sued Classy Hotels for personal injury caused as she believed the business had breached their duty of care to her by not maintaining the lawns. The hotel’s liability insurance covered the legal costs to defend the business in court, as well as the compensation which the business was held liable to pay the client. Due to the prior injuries and the customer being under the influence, the business was successfully able to argue that they had not breached their standard of care.
